Indianapolis—Eli Lilly and Co. will pay $22.5 million to settle a lawsuit brought by the state of West Virginia claiming the company improperly marketed its antipsychotic drug Zyprexa.
Lilly resolved a marketing probe in January with the Justice Department, promising to pay $1.42 billion, including about $362 million to over 30 states.
Lilly will pay $15.75 million to West Virginia and $6.75 million to its lawyers, according to a court filing unsealed Thursday. The suit was one of a dozen state Medicaid reimbursement claims. Lilly announced July 22 it would take a pretax charge of $102 million for settling “several” state Zyprexa suits. (Bloomberg)

Eli Lilly in $1.4B Zyprexa settlement

Pharmaceutical company agrees to settle suits over questionable marketing of drug for off-label uses.

NEW YORK (Reuters)—Eli Lilly and Co. said it will pay about $1.42 billion to settle both criminal and civil investigations related to the marketing of its antipsychotic drug Zyprexa and has agreed to plead guilty to one misdemeanor violation of the Food, Drug, and Cosmetic Act.

The drug maker has agreed to pay $615 million to settle the criminal investigation and about $800 million to settle the civil investigations brought by the State Medicaid Fraud Control Units of the states.
Lilly said the misdemeanor plea is for the off-label promotion of Zyprexa between September 1999 and March 2001.

Also, as part of the settlement, Lilly has entered into a corporate integrity agreement with the Office of Inspector General of the U.S. Department of Health and Human Services.
